Terms of Service

The Golden Wall is a digital entertainment and advertising platform. By paying an amount of your choosing, you purchase an entry (“placement”) on a public leaderboard (“the Wall”). The entry consists of a name or handle, optionally an image, a short text (“punchline”) and a link to a website or social media profile.

Placement is determined solely by the amount paid: whoever has paid the highest amount is displayed at position 1 (“the throne”). All other entries are listed below in descending order of amount.

If another user pays a higher amount, that user takes position 1. The previous entry loses the throne but remains permanently visible on the Wall and continues to be shown in the public list of past placements (“Fallen Rulers”) — including name, image, punchline, amount and link.

There is no entitlement to any particular duration at position 1. The duration depends solely on whether and when another user pays a higher amount, and may therefore be only a few minutes. There is no entitlement to a minimum duration, a specific level of visibility, reach, click numbers or commercial success.

This service is not gambling, a lottery, a contest, or an auction within the meaning of § 156 of the German Civil Code (BGB). No cash prizes, physical prizes or payouts are promised or granted. The amount paid is solely the fee for the digital placement described above and its display. The outcome is not based on chance; it results exclusively from the amounts paid.

The contract is concluded when you successfully complete the payment process. The minimum amount for position 1 is always 1 EUR above the current highest paid amount and is shown before checkout. All prices are final prices in Euro and include statutory VAT where applicable.

Payments are processed by an external payment provider (Base44 Payments / Wix). Payment data is processed there; we do not receive full card details. An entry is published only after payment has been confirmed.

Consumers generally have a 14-day right of withdrawal. As this service consists of digital content that is published immediately after payment, the right of withdrawal expires pursuant to § 356 (5) BGB once you expressly consent to immediate performance and confirm that you thereby lose your right of withdrawal. This consent is obtained during checkout. Once the entry has been published, refunds are excluded to the extent permitted by law.

You are solely responsible for the content you submit (name, image, punchline, link) and confirm that you hold all necessary rights to it. You grant us a non-exclusive, royalty-free right to display this content publicly as part of the platform and in promotion of it.

Content is not permitted if it:

• infringes third-party rights (copyright, trademark, personality rights),
• is insulting, discriminatory, glorifies violence, is pornographic, extremist or harmful to minors,
• is misleading, or links to malware, fraud, illegal offers or phishing,
• violates applicable law.

We reserve the right to edit, hide or remove entries containing such content without prior notice. In such cases there is no entitlement to a refund of the amount paid.

We aim to keep the platform permanently available but do not warrant any specific level of availability. Maintenance, technical faults or circumstances beyond our control may cause interruptions. We reserve the right to further develop the design, functionality and presentation of the Wall, provided the essential service (display of your entry including its placement) is preserved.

Should operation of the platform be discontinued permanently, entries will no longer be displayed. There is no entitlement to display for an unlimited period of time.

We are liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In cases of simple negligence we are liable only for breach of a material contractual obligation and limited to foreseeable damage typical for this type of contract. Liability for external content linked from entries is excluded.

Use of the platform is permitted only to persons aged 18 or over with full legal capacity. By completing the payment process you confirm that you meet this requirement.

German law applies. For consumers, mandatory consumer protection provisions of their country of residence remain unaffected. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
